  Membership Criteria
 

Whether you are new to Avaya or an existing Avaya BusinessPartner, if you know of end-user opportunities for Avaya products/solutions that you cannot fulfill directly, Sales Influencer is open to you.

NON-AVAYA PARTNERS- Whether you are new to the VoIP business, aligned with a competing vendor, or in a complementary industry, the Sales Influencer Program is a great way to start working with Avaya with no commitment. In addition to earning commissions you can leverage the Avaya ecosystem to grow your business including alignment with local teams, access to product information, industry news, and regional events.

EXISTING AVAYA SMALL & MEDIUM PARTNERS (SMBS) PARTNERS- As an existing SMBS Partner, how do you handle Enterprise sales opportunities as they arise? The Sales Influencer Program is a great way to refer them to a Certified Enterprise Partner and be compensated for your efforts by Avaya.

EXISTING AVAYA ENTERPRISE PARTNERS- The Sales Influencer Program is an excellent tool to leverage for those opportunities that you identify outside of your authorized geography.

EXISTING AVAYA DEVCONNECT PARTNERS- You build the next generation of intelligent communications solutions but your business is not authorized to resell Avaya products. This is a great program to refer those opportunities you uncover to an Avaya Partner and be compensated.

EXISTING AVAYA CUSTOMERS- You already know the benefits of our solutions and now you can refer other firms in your network and receive compensation.

Rules and Terms for Participation in the Avaya Sales Influencer Program

  • Program participation requires Avaya’s written approval, which will be provided in writing after submittal and acceptance of Participant’s application and is at Avaya’s sole discretion. Avaya reserves the right to modify the terms of this program and/or terminate Participant’s participation at any time, without cause.
  • Participants must provide at least 2 leads per year.
  • Participants (including their affiliates and employees) may not leverage the program for their own internal use.
  • A Qualified Lead refers to a new sales opportunity not already registered within Avaya’s systems… or otherwise being pursued either by Avaya or an authorized Avaya Reseller. Avaya will qualify each lead and retains absolute discretion on whether to accept the sales opportunity information submitted by a Participant as a Qualified Lead. Avaya also retains absolute discretion on the distribution of the Lead information, including the designation of a Reseller to secure and execute the eventual sale.
  • Only Avaya products (hardware and software) are eligible for compensation under this program. Avaya services, maintenance, and 3rd party products and services are excluded.
  • Compensation shall be in the form of a cash payment of five percent (5%) of the National List Price (NPL) of the solution of Avaya products & software sold by an Avaya authorized Reseller as a direct result of an accepted Qualified Lead, within twelve months of the Participants submission, and Avaya’s acceptance of the Qualified Lead information.
  • The relationship of the parties under this Agreement shall be at all times one of independent contractors, and not that of joint venturers, or principal and agent, and no fiduciary relationship exists between the parties. Neither party shall have any authority to assume or create obligations on the other's behalf. Participation in the Program does not give Participant a license to use Avaya’s trademarks, logos or copyright protected materials. This Agreement and any disputes arising out of or relating to this Agreement (“Disputes”) will be governed by the laws of the state of New Jersey, excluding conflict of law principles.

LIMITATION OF LIABILITY. IN NO EVENT WILL AVAYA HAVE ANY LIABILITY FOR ANY INCIDENTAL, SPECIAL, STATUTORY, INDIRECT, CONSEQUENTIAL DAMAGES, OR LOSS OF PROFITS OR REVENUE. AVAYA’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH THIS PROGRAM WILL NOT EXCEED THE LESSER OF $25,000 OR THE COMPENSATION AMOUNT REGARDING EACH INDIVIDUAL OPPORTUNITY IN QUESTION, IF APPLICABLE. THE LIMITATIONS OF LIABILITY IN THIS SECTION WILL APPLY TO ANY DAMAGES, HOWEVER CAUSED, AND ON ANY THEORY OF LIABILITY.
